OUR WORK

We have been active in select litigation of constitutional kind to preserve the dynamics of checks and balances among the three branches of government, with emphasis on the independence of the judiciary and the integrity of public office, as well as the preservation of public order and individual rights, against ideologically abusive and intolerant behavior by the State.

Some of the efforts undertaken in the period 2021-2024 are listed below:

Ethical complaint against Mr. Gregorio Jorge Dalbón dated 7/9/2021 before the Disciplinary Tribunal of the Public Bar Association of Buenos Aires, Panel III, Docket No. 32157, for unethical conduct of a licensed attorney against magistrates of the nation. Mr. Dalbón claimed to be the attorney of former Presidents Alberto Fernández and Cristina Fernández de Kirchner, as well as former Minister of Economy Sergio Massa. With firm condemnatory judgement against Mr. Dalbón.

Mr. Dalbón claimed to be the attorney of former Presidents Alberto Fernández and Cristina Fernández de Kirchner, as well as former Minister of Economy Sergio Massa. Currently under appeal before the Supreme Court of Justice.

Rodríguez Varela, Ignacio vs. Republic of Argentina, Interamerican Commission of Human Rights. P-168-13, complaint admitted through Report 69/22, and registered as Case 14,968, Argentine Republic.” Process for violation of human rights in the discrimination suffered by Mr. Rodríguez Varela as a candidate to be nominated as magistrate by the executive power for many years. Trusted Counsel, Amicus Curiae, Class 1986-1991, Catholic University of Argentina. Currently awaiting the decision of the Interamerican Commission of Human Rights.

“Irazu, Fernando G. c/ EN-Council of the Judiciary of the Nation and others-Law 24,937, on Writ of Amparo, Law 16,986”, National Federal Administrative Court No. 6, for discrimination of the private educational sector against the principle of equality before the law, access to public office, and independence of the judiciary. Currently under appeal before the Federal Administrative Court of Appeals.

“Docket no. 17040/2023 Civil Association Republican Action for Justice v/ IGJ 1971615 on direct appeal, Panel L, Civil Court of Appeals” for violation of the right of association, equality before the law, and religious freedom, among others. Currently before the Supreme Court of Justice after extraordinary appeal having been granted.

Criminal complaint: “Nissen , Ricardo Augusto for abuse of power and dereliction of duties by a public officer” (regarding the ruling of the Commercial Court of Appeals, Panel C, in re, “Haras Pino Solo SA v. Inspection General of Justice IGJ No. 25/2020 and No. 27/2020”), CFP 5315/2021, Federal Criminal Court No. 8. The new administration of the General Inspection of Justice (IGJ) overruled the regulations of “identity politics” illegally promoted by Mr. Nissen, which impacted the checks and balances among the branches of government, in particular the role of the judiciary, and prompted this complaint.

Criminal complaint: “NN a/ aggravated damage (mob attacks on the Cathedral of the City of Buenos Aires – Mausoleum of Gral. San Martín – and Cabildo during the so-called Easy Trigger Protest), CFP 5479/2021, Federal Criminal Court No. 5. The previous Mayor of the City of Buenos Aires then proceeded to fence the Cathedral to prevent such attacks, thus maintain public order and comply with the duties of such public officer, and not to resort to taxpayers’ funds to then repair the damages resulting from such sort of unconstrained antisocial and criminal behavior.

Criminal complaint: “Fernández, Alberto – Pacchi , Sofía and others a/ violation of measures – spread of epidemic (art. 205), abuse of power and dereliction of duties of a public officer (art. 248)”, CFP 4723/2021, Federal Criminal Court of San Isidro No. 2. Private prosecutor against former president Alberto Fernández due to the scandal caused by the violation of his own criminal normative in the so-called “Olivosgate”: an illegal birthday party during the extremely rigid and long Covid-19 lockdown imposed by him. All of this, after former president Fernández requested from judges and prosecutors the maximum criminal rigor upon possible violations of his own regulations by the Argentine citizenry. Such despotic and tyrannical attitude prompted our broader institutional effort for the benefit of the Republic of Argentina.
